When does a Temporary Order Become Permanent?

After your temporary order is put into place you will then have the opportunity to talk to your attorney about what matters to you and what you want the final order to say. Your soon-to-be ex-spouse will also have this opportunity, so it is crucial that you retain effective counsel, to ensure that your interests and future are protected.

The final order will usually include the following:

  • How assets and property will be divided;

  • Child custody and visitation;

  • Alimony;

  • Child support;

  • Any additional factors that the parties wish to be included.

How long this process takes depends mostly on how quickly the parties can come to an agreement. If negotiation and mediation fail, then the case will have to be taken to trial, where either a judge or a jury will decide how everything will be distributed. Ideally, the parties will be able to negotiate an agreement within a reasonable amount of time and a trial won’t be necessary. However, if your spouse continues to be unreasonable and irrational, we will not hesitate to take it to trial.
